What types of prescription errors do you handle?

The Food and Drug Administration states that The National Coordinating Council for Medication Error Prevention and Analysis (NCC MERP) defines a medication error as, “Any preventable event that may cause or lead to inappropriate medication use or patient harm while the medication is in the control of a healthcare provider, patient, or consumer.”

Some of the many types of medication/prescription errors our Seattle prescription errors handle include the following:

  • Prescribing the wrong medication. There are two problems with prescribing the wrong medication. The first is that the patient is not receiving the medication they need to treat their disease, injury, or any other medical condition. This, at best, delays the time they receive the proper medication. At worst, the delay can mean the medical condition is no longer treatable. The second problem is that the improper drug could harm the patient.
  • Not receiving the correct medication. Here, the pharmacy fills the prescription correctly but the pharmacy then fails to give the patient the prescription they ordered. For example, the patient may receive a medication that was prescribed for another patient.
  • Prescribing or administering the wrong dosage. Pharmacies may give a patient the wrong dosage. The doctors, nurses, anesthesiologists, and other healthcare professionals who provide medications to their patients may not provide the correct dosage to the patient. Receiving the improper dosage can prevent the patient’s condition from being treated properly.
  • Not explaining the proper way to administer the medication. Filling a prescription is just one part of delivering a drug to a patient. The doctor who prescribes medication, the pharmacist who provides instructions to the patient, and the medical providers who administer medications need to ensure that the medication is taken or administered correctly. Some medications can be chewed; many need to be taken whole. Some medications need to be taken orally; others may need to be injected, applied, or administered in other ways. If a medication is to be injected, the prescription should make clear where the drug should be injected.
  • Labeling errors. The manufacturer and pharmacy need to ensure that their labels contain the correct information for who is to receive the medication – and when, how often, and how the medications should be taken.
  • Failing to understand drug interactions. The doctors prescribing medications and the pharmacy that is filling a medication should check whether the patient has any allergies and what medical conditions the patient has that might make taking the prescribed medication cause dangerous reactions or side effects.
  • Compliance errors. For example, drug manufacturers need to comply with FDA regulations.

Other prescription errors include prescribing the medication too early or too late or prescribing the wrong duration.

Why do prescription errors happen in Seattle?

At Smith McBroom, our medical malpractice lawyers work with doctors, pharmacists, and drug manufacturers when necessary to determine what prescription errors occurred and why those errors were preventable.

Some of the reasons prescription errors happen include:

  • Not diagnosing the patient’s medical condition properly.
  • Not understanding the patient’s full medical history including their family history, personal characteristics such as weight and height, and the medications they already take.
  • Defective design or manufacture of the drugs by the drug manufacturer.
  • Improper instructions by the manufacturer, prescribing doctor, pharmacist, or person administering the medications.
  • Illegible handwriting.
  • Communication failures.
  • Understaffing.
  • Improper data entry.
  • Improper stocking or scanning.
  • Failure to distinguish the medication from similar medications.
  • Failure to follow up with the patient to see how the medications are working.
  • Failure to check the expiration date.

According to the National Center for Biotechnology Information (part of the National Institute  of Health), medication errors may occur during the following stages:

  • Ordering and prescribing
  • Documenting
  • Transcribing
  • Dispensing
  • Administering
  • Monitoring

The NIH also reports that “nearly 50% of all medication errors occur when a medication is prescribed or ordered. Studies reveal that nurses and pharmacists identify 30% to 70% of medication-ordering errors. Medication errors are a pervasive but preventable problem.”

The risks of medication errors increase with older patients and patients who take multiple medications.

What are the consequences of prescription mistakes?

Prescription errors can prevent a patient from receiving the treatment they need or cause the patient new harm. Medication errors can cause severe reactions, physical injuries, and emotional trauma. Patients often need additional medical care. Some patients may need to be hospitalized. Some patients may die.

Our Seattle prescription error lawyers work to show why the medication mistake was preventable. We also work to show the full consequences of the medication mistakes including what treatments patients will need because of the errors and how the medical malpractice will affect every aspect of their lives.

Who is responsible for prescription errors in Seattle?

Prescription errors can happen in many places, at many stages of a patient’s treatment, and by many different healthcare professionals.

We pursue medical malpractice claims against various healthcare providers and entities, including:

  • Family physicians, specialists, surgeons, and anesthesiologists.
  • Hospitals, nursing homes, and pharmacists.
  • Drug manufacturers and distributors.

How much is my Seattle prescription error lawyer claim worth?

We demand compensation for the following financial and personal damages when medication mistakes happen:

  • All your current and future medical bills. These include the cost of any corrective treatments and medications. They also include emergency medical care, hospitalizations, surgeries, doctor visits, rehabilitative therapy, the correct medications, and any assistive devices or technology.
  • Your lost income and benefits. This amount should compensate you for every workday you’ve already missed and every day you won’t be able to work for the rest of your life.
  • Your pain and suffering. You’re entitled to be compensated for all your daily aches and pains, and your anxiety, stress, worries, and depression.
